Personal Injury Claims

If you’ve been injured in an accident due to someone else’s negligence, you may be entitled to compensation. Personal injury law in NSW can be complex, and strict time limits apply. Our team is here to guide you through the process, ensuring you understand your rights and receive the compensation to which you are entitled.

Types of personal injury claims

We can assist with a range of personal injury claims, including:

  • Motor Vehicle Accidents

  • Workplace Injuries

  • Public Liability Claims

  • Professional Negligence

Workers Compensation Statutory Benefits Claim & Work Injury Damages Claim

We have particular expertise in helping clients pursue both workers compensation statutory benefit claims and work injury damages claims, ensuring you get the best possible outcome.

If you’ve been injured at work, you may be entitled to compensation by way of a Statutory Benefits claim for medical expenses, weekly benefits, assistance with daily living support and lump sum payments for permanent impairment.

If your injury was caused by negligence and meets the legal threshold specified for Whole Person Impairment (WPI), you may be eligible to bring a claim for additional compensation for past and future economic loss. This is called a Work Injury Damages claim, or a Common Law claim.

Our litigation team are ILARS-approved lawyers, which means eligible workers can access our help at no cost to them through the Independent Review Office (IRO).

Dust Diseases

Exposure to harmful dust in industries like mining, construction, and manufacturing can lead to serious diseases including asbestosis, silicosis, and mesothelioma. If you’ve been diagnosed with a dust-related disease, you may be entitled to compensation.

Unlike other workplace injuries, dust diseases often have a long latency period, meaning symptoms may not appear until many years after initial exposure. As a result, workers exposed decades ago may still be entitled to compensation.

We understand the complexities of dust disease claims and are here to help you navigate the legal process. If you're unsure about your eligibility, we’ll help clarify your rights and options.

Types of compensation available:

ICare dust disease care

This service provides treatment and financial support for workers who develop a compensable dust disease in NSW. ICare Dust Diseases Care offers lung screening and provides financial assistance for eligible workers living with a dust disease, including funding for medical treatment.

Common law claims

If negligence contributed to the exposure (for example, an employer’s failure to provide protective measures), workers may be entitled to additional compensation for pain and suffering, medical expenses, and past and future loss of earnings.

Claims for families

In cases where a worker has passed away due to a dust disease, surviving family members may be able to claim compensation for loss of support and funeral expenses.

Navigating compensation claims can be complex. Our litigation team is experienced in compensation claims and will help you secure the compensation you’re entitled to.
