Wills & Estate Planning
Actively planning ahead gives peace of mind to you and your loved ones. At Cultivate Legal, we take the time to thoroughly understand your personal circumstances in terms of your finances, family relationships and who you would like to benefit in the event of your death. We provide clear, tailored advice and documents to effectively implement your wishes, including Wills, superannuation death benefit forms, Powers of Attorney and Appointments of Enduring Guardian.
Wills
A Will takes effect when you die. In your Will, you appoint your executor/s to administer your estate, trustees to manage any trusts created by your Will, appoint guardians of your children if they’re under 18 years of age and gift your estate to your intended beneficiaries.
Preparing a Will can be confronting. At Cultivate Legal, our estates team are empathetic, approachable and practical. We will work closely with you to make a Will that gives effect to your intentions, allowing you to be proud that you have taken the steps necessary to look after your family.
Powers of Attorney
Powers of Attorney are powerful documents that allow you to appoint one or more substitute decision makers for your legal and financial affairs while you are alive. We will tailor your Power of Attorney to the suit your personal circumstances, including whether they are to come into effect immediately, or only if you lose capacity to manage your affairs, or for limited times such as if you are going overseas.
We can also assist with Corporate Powers of Attorney to ensure that your companies always have authorised individuals to manage the company’s legal and financial affairs.
Appointments of Enduring Guardian
An Appointment of Enduring Guardian allows you to appoint one or more persons to make medical and lifestyle decisions for you if you are unable to do so yourself. These decisions may include where you live and what medical or other treatment you do or don’t receive.
Succession Planning
If you run a business, partnership or company, or have a self-managed superannuation fund or interest in a family trust, a clear succession plan is essential. Knowing and understanding how your assets and liabilities are held, what would happen to the business/entity in the event of your death and the tax implications of death and passing of assets is fundamental. Working closely with your accountant and financial adviser, we offer practical and independent guidance, which is particularly helpful for family-run businesses and farms.
